1. Agreement to Terms
By accessing or using the MNMS Logistics platform, services, or mobile applications (collectively, the "Services"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you do not have permission to access the Services.
These terms constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you", "Carrier", "Shipper"), and MNMS Logistics ("Company", "we", "us", or "our").
2. Service Obligations
- Carrier Compliance: All carriers must maintain active operating authority (MC/DOT), adequate insurance coverage as defined in the Carrier Agreement, and comply with all Federal Motor Carrier Safety Administration (FMCSA) regulations.
- Load Acceptance: Acceptance of a load via the MNMS platform constitutes a binding legal commitment to transport the freight according to the specifications in the provided rate confirmation.
- Tracking & Visibility: Carriers agree to provide continuous location updates via our approved macro-tracking solutions during the active transit of any booked load.
- Detention & Layover: Claims must be submitted within 24 hours of delivery with supporting documentation (stamped BOLs, verified in/out times) to be considered for broker reimbursement.
3. Liability Limitations
MNMS Logistics operates solely as an independent freight dispatching service representing motor carriers. We do not take possession of, handle, or transport freight, nor do we act as a licensed freight broker. Therefore, MNMS Logistics is not liable for cargo damage, loss, or delay in transit.
"In no event shall MNMS Logistics, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service."
4. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
